Case: POLICE CAPTAIN DISCIPLINARY CHARGES OF SERIOUS MISCONDUCT
A decorated, veteran police Captain was served on Christmas Eve with a multi-count Preliminary Notice of Discipline. The charges alleged theft and/or destruction of data equal to “millions” of pages of documents, and were being brought for the purpose of putting the officer’s hard-earned pension and lifetime health benefits in jeopardy. The people in control of the municipality stack the deck against the officer by utilizing multiple law firms and a Hearing Officer that the current township counsel had made Police Chief earlier in the Hearing Officer’s decorated career. And, the municipality had a hired-gun “expert” — a man claiming he was a former U.S. Secret Service agent who published report after report containing misleading “expert” claims against the former police Captain.
RESULT: All charges were dropped after we established there was no basis to proceed under the Attorney General Guidelines.
Case: MEDICAL PRACTICE BUSINESS BREAKUP INVOLVING ACCOUNTANT & POWERHOUSE NEW JERSEY LAW FIRM
Client physicians were being financially abused in a medical practice. When a prior doctor tried to leave the practice, he exited only after paying (we were told) hundreds upon hundreds of thousands of dollars. The business’s high-profile law firm threatened openly that the same would happen to our clients. We pursued three successful applications to the Appellate Division, and ultimately had that law firm barred from the case because the law firm had a material, improper conflict of interest. Following that, we uncovered that one of the shareholder physicians we were fighting had lost his medical license to settle an investigation into his unlawful disbursement of a controlled substance.
RESULT: Our clients successfully separated from the practice and the business dropped its claims.
Case: REGISTERED NURSE SUBJECTED TO AGGRESSIVE SEXUAL HARASSMENT BY UPPER MANAGEMENT MEMBER
Client lived through a horrifying array of aggressive sexual harassment by upper management member who demonstrated he wanted a sexual relationship. We uncovered key “me too” witnesses who, like our client, were subjected to grossly inappropriate behaviors in an office that was out of control. Commenced litigation after efforts seeking pre-suit settlement failed.
RESULT: Secured significant confidential monetary settlement; manager fired.
Case: POLICE CHIEF FORCED OUT OF WORK BY MUNICIPAL ABUSE
Matters involved a decorated member of police command forced out of work through unlawful abuse, including abused that was politically motivated. Litigation pursued in state.
RESULT: Secured significant confidential monetary settlement.
Cases: NEAR-DEATH CONSTRUCTION WORKER INJURY ACCIDENT
During NYC Hudson River park project, construction worker working in a boat on the river was slammed in the face and head by moving steel cable. Significant head and facial trauma, including claim of cognitive deficit from brain injury. Defended billion-dollar, multi-national construction company based in Europe. Multiple party defendants with cross-claim disputes involving tort liability, Labor Law liability, and insurance coverage issues.
RESULT: Case settled without our client paying a penny to the other parties, and with recovery of our client’s attorney’s fees.
Case: AUDIT MALPRACTICE CLAIM AGAINST ACCOUNTING FRIM PRESENTED WITH $40,000,000+ EXPOSURE
Complex, large-scale litigation defense in which more than 1,000,000 pages of records were produced in discovery. Based upon two single sheet of paper discovery among the 1,000,0000 pages, Mr. Deininger confronted audit client’s former executive president at deposition. Working as mid-level associate for major Park Avenue law firm, Mr. Deininger obtained admission that the audit client knew of but failed to disclose the improper practice to the accountant auditor. Litigated the matter in federal court.
RESULT: Case settled for less than 10 cents on the dollar.
